Doug’s Boutique

1. Introduction
These Retail Sales Terms & Conditions (“Terms”) govern the sale of New Products, Used Products, and Consignment Item(s) (collectively, “Products”) by Doug’s Boutique (“we,” “us,” or “our”) to Customers (“you” or “your”). By purchasing any Products from Doug’s Boutique, you acknowledge that you have read, understand, and agree to be legally bound by these Terms.
2. Definitions
- “Doug’s Boutique,” “we,” “us,” or “our” means Doug’s Boutique, a retail business operating in the Commonwealth of Pennsylvania.
- “Customer,” “you,” or “your” means any person or entity purchasing Products from Doug’s Boutique.
- “Products” means New Products, Used Products, and Consignment Item(s) offered for sale by Doug’s Boutique.
- “Purchase Price” means the total price for a Product as stated at the time of sale, before applicable sales tax, fees, shipping (if any), and any other charges, unless those amounts are expressly included in the stated price.
- “Sales Receipt” means the receipt, invoice, or other proof of purchase issued by Doug’s Boutique for a transaction, in paper or electronic form, which may include the date of purchase, items purchased, and amounts paid.
- “New Products” means Products sold as new and not previously owned by a consumer, unless otherwise disclosed.
- “Used Products” means Products that have been previously owned or used and are sold in used condition.
- “Consignment Item(s)” means a Product offered for sale by Doug’s Boutique on behalf of a third party.
- “Consignor” (collectively, “Consignors”) means the third-party owner who places Consignment Item(s) with Doug’s Boutique for sale.
- “Terms” means these Retail Sales Terms & Conditions, as amended from time to time.
3. Product Condition and Testing
- Doug’s Boutique offers New Products, Used Products, and Consignment Item(s).
- Used Products and Consignment Item(s) are thoroughly tested and refurbished to the best of our ability prior to sale.
- All Products are sold in working condition unless otherwise disclosed.
- Any material issues or defects known to us will be clearly disclosed to the Customer prior to purchase.
- Products are sold “as-is” and “with all fault” unless otherwise specified in writing.
- The Customer is responsible for inspecting Products prior to purchase and acknowledging any disclosed defects.
4. Consignment Sales
- Consignment Item(s) are sold on behalf of third-party owners (“Consignors”).
- Doug’s Boutique acts solely as an agent in these transactions and does not take ownership of Consignment Item(s).
5. Sales and Payment Terms
- All sales are final except as specifically provided herein.
- Payment is due in full at the time of purchase.
- Accepted payment methods include cash, credit/debit cards, and other forms as may be specified by Doug’s Boutique.
- Sales tax and other applicable fees will be added to the Purchase Price as required by law.
- Doug’s Boutique reserves the right to refuse a sale or cancel a transaction to the extent permitted by law.
6. Returns and Refunds
- Returns and refunds are generally not accepted except under the following conditions, as determined by Doug’s Boutique in is sole discretion:
- New Products:
- Unopened single-use New Products are eligible for returns only if, no later than thirty (30) days after the date of the sale, Customer provides the New Product, original packaging, and Sales Receipt, in which case, the Customer shall be entitled to a refund of the Purchase Price less a re-stocking fee equal to twenty percent (20%) of the Purchase Price including any applicable sales tax, fees, shipping (if any), and any other charges.
- Opened single-use New Products are not eligible for returns unless, in Doug’s Boutique’s sole discretion, the Product is defective, in which case, the Customer must, no later than thirty (30) days from the date of the sale, provide the New Product, original packaging, and Sales Receipt.If Doug’s Boutique determines in its sole discretion the Product is defective, then the Customer shall be entitled to a refund of the Purchase Price less a re-stocking fee equal to twenty percent (20%) of the Purchase Price including any applicable sales tax, fees, shipping (if any), and any other charges.
- Serialized New Product inventory are not eligible for returns unless, in Doug’s Boutique’s sole discretion, the Product is in re-sale condition, in which case, the Customer must, no later than thirty (30) days from the date of the sale, provide the New Product, original packaging, and Sales Receipt. If Doug’s Boutique determines in its sole discretion the Product is in re-sale condition, then the Customer shall be entitled to a refund of the Purchase Price less a re-stocking fee equal to twenty percent (20%) of the Purchase Price including any applicable sales tax, fees, shipping (if any), and any other charges.
- Used Products –Used Products shall not be returned under any circumstances, and no refund shall be paid to the Customer.
- Consignment Items shall not be returned under any circumstances, and no refund shall be paid to the Customer.
- Refunds, if granted, will be processed in the original form of payment unless otherwise agreed in writing.
- Doug’s Boutique reserves the right to inspect returned Products and deny refunds for items that have been used, damaged, or altered after sale in the sole discretion of Doug’s Boutique.
7. Warranties and Disclaimers
- New Products may include a manufacturer’s warranty, as specified by the manufacturer.
- Used Products and Consignment Item(s) are sold “as-is,” and “WITH ALL FAULTS” with no warranties express or implied.
- Doug’s Boutique hereby DISCLAIMS ALL WARRANTIES, EXPRESSED OR IMPLIED, INCLUDING WARRANTY OF MERCHANTABILITY AND WARRANTY OF FITNESS FOR A PARTICULAR PURPOSE, AND ANY WARRANTY FOR GOOD AND WORKMANLIKE MANNER.THIS WARRANTY DISCLAIMER IS ALSO INTENDED TO APPLY TO ANY LATENT DEFECTS.
- The Customer acknowledges that Used Products and Consignment Item(s) may exhibit signs of wear, prior use, or modification.
- Any warranty claims for New Products must be made directly to the manufacturer.
- Nothing in these Terms limits any consumer rights or remedies that cannot be waived under applicable federal or Pennsylvania law.
8. Limitation of Liability
- UNDER NO CIRCUMSTANCES, WHETHER ARISING IN CONTRACT, TORT (INCLUDING NEGLIGENCE), EQUITY OR OTHERWISE, SHALL DOUG’S BOUTIQUE BE RESPONSIBLE, OR LIABLE, FOR ANY SPECIAL, INDIRECT, OR CONSEQUENTIAL DAMAGES ARISING FROM OR IN CONNECTION WITH THE PURCHASE OR USE OF ANY PRODUCT.
- Doug’s Boutique’s total liability for any claim arising from or related in any way to the sale of a Product will not exceed the amount paid for the Product in question.
- This limitation applies regardless of the legal theory asserted, including contract, tort, or statutory claims.
9. Privacy Policy
- Doug’s Boutique is committed to maintaining the confidentiality of the personal information we collect.We collect and use the information to the extent needed to conduct our business and to meet our high quality service standards.
- We do not sell Your personal information.
- We restrict access to the information to authorized individuals of Doug’s Boutique who need to know this information to provide services and products to you.
- We maintain appropriate safeguards to protect information about you.
- We will verify that any persons requesting information about you or your relationship with us is entitled to such information prior to providing it.
- We share nonpublic personal information about you outside Doug’s Boutique only to service your request, or as authorized by you, or as required or permitted by acceptable law.
10.Governing Law
- These Terms are governed by the laws of the Commonwealth of Pennsylvania, regardless of conflict of law principles.
- Venue for any permitted court action shall be in Dauphin County, Pennsylvania.
- Before filing any claim, the parties agree to attempt in good faith to resolve disputes informally (in person, phone, or email). If informal resolution fails, disputes may be brought in any court of competent jurisdiction.
- If a court of competent jurisdiction finds any provision of these Terms to be illegal, invalid, or unenforceable as to any circumstance, that finding shall not make the offending provision illegal, invalid, or unenforceable as to any other circumstance. If feasible, the offending provision shall be considered modified so that it becomes legal, valid and enforceable. If the offending provision cannot be so modified, it shall be considered deleted from this Agreement. Unless otherwise required by law, the illegality, invalidity, or unenforceability of any provision of these Terms shall not affect the legality, validity or enforceability of any other provision of these Terms.
11. Amendments
- Doug’s Boutique, in its sole discretion, may update, modify, or change these Terms from time to time and without advance notice to the Customers.
- The current version of the Terms will be made available in-store and may also be posted on our website.
- Continued purchases after any amendment constitute acceptance of the Terms then in effect.
